End User License Agreement

This End User License Agreement (“EULA”) governs your use of Swelter(“the App”), published by Alican Basak, on Apple devices.
1. License grant
We grant you a personal, non-transferable, non-exclusive license to use the App on any Apple device that you own or control, in accordance with the Apple Media Services Terms and Conditions and Apple’s standard Licensed Application End User License Agreement.
2. In-app purchases
The App offers a one-time, non-consumable in-app purchase that unlocks additional features. Payment is charged to your Apple Account at confirmation of purchase. A non-consumable purchase does not renew and is not billed again. Purchases can be restored on any device signed in to the same Apple Account. The title and price of the purchase are shown in the App before you buy.
3. Not a medical device — important
The App is an informational tool. It is not a medical device and does not diagnose, treat, or prevent heat illness or any other condition. Heat index and related values are estimates computed from temperature and humidity, and conditions at your exact location may differ from the reported data. Never rely on the App as your only source of safety information. In an emergency, call your local emergency number or seek medical help.
4. Data sources and independence
Weather data is provided by the U.S. National Weather Service (public domain) in the United States and by Apple Weather elsewhere. Heat index thresholds and work/rest guidance are based on published public information from OSHA, NIOSH, the CDC, and the National Weather Service. The App and its publisher are not affiliated with, endorsed by, or connected to any of those organizations, nor to Apple beyond the ordinary App Store relationship.
5. Restrictions
You may not reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App. You may not redistribute, resell, rent, or sublicense the App. You may not use the App to attack, probe, or disrupt any service the App connects to.
6. Apple's standard EULA
This EULA is in addition to Apple’s standard Licensed Application End User License Agreement. Where the two conflict, the more restrictive term applies. Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
7. Updates
Updates are delivered through the App Store. Some updates may be required for the App to keep functioning correctly.
8. Termination
This license ends automatically if you breach any of its terms or uninstall the App. On termination you must stop using the App and delete it from your devices.
9. No warranty
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law.
10. Governing law
This EULA is governed by the laws of Turkey, without regard to its conflict-of-law principles.
